Who Pays for Damages After an Uber or Lyft Accident?
Both Uber and Lyft carry third-party liability coverage. In some circumstances, they will pay up to $1 million for any property damage or injuries you may suffer. However, it’s important to know that this policy will only kick in after the driver’s own insurance has been exhausted. Both companies require their drivers to have their own insurance. As a passenger, you’re covered under these policies if the driver is at fault.
Uber and Lyft’s insurance coverage for accidents involving their drivers depends on the situation:
- Situation One: When the Rideshare Driver Does Not Have the App Turned on: Uber and Lyft offer no insurance coverage for a driver that does not have the app turned on. If you are involved in an accident with an Uber/Lyft driver who was not carrying a passenger, looking for a passenger, or did not have the app turned on, you can pursue a typical car accident claim with the driver’s private auto insurance provider.
- Situation Two: When the Rideshare Driver Has the App Turned on but Does Not Have a Passenger: If the app is turned on and the Uber/Lyft driver is looking for a passenger or has accepted a ride but has not picked up the passenger yet, Uber and Lyft offer coverage in the amounts of up to $50,000 for bodily injury per person and up to $100,000 in bodily injury per accident, as well as up to $25,000 in property damage.
- Situation Three: When the Rideshare Driver Has the App Turned on and Is Carrying a Passenger: If the Uber/Lyft driver has the app turned on and is transporting a passenger, that is when both Uber and Lyft’s $1 million insurance coverage kicks in. Remember, this coverage is only available after the rideshare driver’s own insurance coverage has been exhausted.
